As I said, I never heard of it. There is an administrative offense called "Gefährlicher Eingriff in den Strassenverkehr" (roughly translates into "dangerous interference with road traffic"), that might come into play here. But that's mostly designed for active offenses, like throwing stones from a bridge, or placing large and heavy items on the road.
So if you run out of gas on the Autobahn, as long as you stop on the emergency lane and properly secure your vehicle, chances are that police wouldn't even stop when they pass by.
But maybe there is a small chance that you will get ticketed. After all, we have gas stations along the Autobahn every 30 km / 20 miles. So unless your fuel indicator is malfunctioning, a certain amount of carelessness would be involved if you manage to run out of gas on the Autobahn. Could be that some cops would write you a ticket for that.
About the fog - we have that here, too. Especially fog banks can be nasty. From one second to the next, clear vision turns into no vision at all. If you then brake, and the guy behind you doesn't, you have exactly the same scenario that led to the crash described in the opening post.
