EU261: AY Wins 9-Year Court Battle

All about Airlines and Airliners.

In a preliminary decision handed down on Thursday, Finland's Supreme Court ruled that Finnair does not need to pay passengers for a Helsinki-Bangkok flight that arrived 20 hours late.

The case has been heard by numerous lower courts for years, and the flight in question took place in March 2016.

The airline cancelled the Bangkok-bound flight just before it was due to depart from Helsinki Airport, due to a technical problem with the aircraft. Passengers on the flight were put on another Finnair plane, and it arrived around 20 hours behind schedule.

It was later found that the technical fault in the aircraft was caused by a design flaw affecting all models of the plane.

Anyone have some insight into what this "design flaw" could have been? What are your thoughts on this ruling?

EDIT:
Further search proved bountiful.
Aircraft was an Airbus A350-900.

Thank you, that's very interesting. Also interesting was the article linked from there that SAS were held liable for compensation for cancellations arising from industrial action; with Finnair's pilots pretty much working-to-rule, that's useful knowledge to have in my back pocket.

I am a little surprised at the ruling in this case, though. When you're practically the launch customer for a brand new type, and you've only had it a few months, something like that cropping up is hardly a shock. I could see the argument if there were hundreds in service when an issue like this cropped up, but as it is, I'm not so sure.
